ClockItz (operated by INSTACLOUD SOLUTIONS LLP) respects the intellectual property rights of others and expects Organizers and Users who upload content to the Platform (such as Event banners, gallery images, and venue photos) to do the same. This policy explains how to report content you believe infringes your copyright, and how we respond.
1. Reporting Copyright Infringement
If you believe content on the Platform infringes a copyright you own or control, send a written notice to our copyright agent (see “Designated Copyright Agent” below) that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it (e.g., a URL or Event name).
- Your contact information — address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
A notice missing these elements may not receive a response.
2. Our Response
Upon receiving a valid notice, we will act expeditiously to remove or disable access to the identified material, and will make a reasonable effort to notify the User or Organizer who posted it. Removed content may be reinstated if we receive a valid counter-notification (below) and do not receive notice of a court action within 10–14 business days of forwarding the counter-notification to the original notifying party.
3. Counter-Notification
If you believe content you posted was removed or disabled by mistake or misidentification, you may send a counter-notification to our copyright agent that includes:
- Your physical or electronic signature.
- Identification of the material removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your address (or, if outside India’s or the applicable jurisdiction, any appropriate jurisdiction), and that you will accept service of process from the person who filed the original notice.
4. Repeat Infringer Policy
Consistent with the DMCA and other applicable law, we will, in appropriate circumstances, disable or terminate the accounts of Organizers or Users who are determined to be repeat infringers of the copyright (or other intellectual property) rights of others.
